Welcome to the nautical.fashion online store (hereinafter: the “Website”). By using this Website and making purchases through it, you accept these Terms of Use. Please read them carefully before using the Website and making a purchase.

  1. GENERAL INFORMATION ABOUT THE SELLER
    The nautical.fashion online store is owned and operated by BCM GROUP d.o.o., Tax ID (PIB) 03167437, Registration number 50815804, established on 18 December 2017, with its registered office at STARI GRAD BR. 436, Kotor, Montenegro. The physical store is located at Trg od kulture 8, 85320 Tivat, Montenegro. Contact phone: +382 67 000 908. Email: info@nautical.fashion.
  2. SCOPE OF BUSINESS
    The Website is an online store specialized in the sale of nautical clothing and related equipment. The displayed logos and brand names SLAM, Zhik and TOIO are the property of their respective parent companies and are used in accordance with a business partnership.
  3. USE OF THE WEBSITE
    The user agrees to use the Website in accordance with the laws of Montenegro, good business practices, and these Terms of Use. Entering inaccurate information, misuse of the ordering system, attempts of unauthorized access to the system, and use of Website content without authorization are prohibited. The Seller reserves the right to restrict or disable access to users who violate these terms.
  4. PRICES AND ACCURACY OF INFORMATION
    All prices on the Website are expressed in euros (EUR) and include VAT as prescribed by law. The Seller reserves the right to change prices without prior notice. In the event of an obvious technical error in the display of price, availability, or product description, the Seller reserves the right to cancel the order with notification to the customer and a refund if payment has already been made.
  5. METHOD OF PAYMENT

    Payment for products in our online store can be made in one of the following ways: by credit/debit cards – VISA, Maestro, or MasterCard that support online payments. Card payments are processed in cooperation with AllSecure d.o.o., while Crnogorska komercijalna banka AD Podgorica authorizes the transaction. Payments are carried out in a secure and certified manner via the AllSecure Payment Gateway, by simply entering your card details.

    Once the card details are entered and the payment is confirmed, the bank authorizes the transaction and the order is approved and proceeds to the next stage of preparation for delivery. The amount will be reserved on your card (account) and will not be available for other purposes.

    The transaction will be completed and the amount charged to your account only once the products have been prepared for shipment and handed over to the courier service. If the payment is not completed, i.e., if the amount is not charged within 14 days from the date your order was accepted, the order will be canceled and deleted. After the 14-day period expires, the reserved funds on your account will be released and made available to you again. You may then place the same or a new order and complete the related payment.

    Please check with the bank that issued your card whether your card supports online payments.

  6. CARD DATA PROTECTION
    When entering payment card details, confidential information is transmitted over a public network in a secure (encrypted) form using the SSL protocol, applying the most advanced tokenization methods for sensitive data and in compliance with PCI-DSS standards. At no point are payment card details available to the merchant.

    3D Secure protection for all merchants and customers – The AllSecure Payment Gateway applies the highest global standards of data security and privacy. All merchants using the AllSecure Payment Gateway are automatically enrolled in 3D Secure protection, ensuring a safe shopping experience for customers. Customers’ card numbers are not stored on the merchant’s system, and data entry is protected by SSL encryption.

    PCI DSS Standards – The AllSecure Payment Gateway is continuously aligned with all card scheme requirements in order to maintain and enhance security levels for both merchants and customers. Since 2005, without interruption, the system has been certified as PCI-DSS Level 1, which represents the highest standard in the industry.

    The PCI Data Security Standard (PCI-DSS) defines the necessary security measures for processing, storing, and transmitting sensitive cardholder data. PCI standards protect sensitive cardholder information throughout the entire payment process: from the moment data is entered at the merchant’s point of sale, during communication between the merchant and the relevant banks and card organizations, as well as during any subsequent data storage.

  7. RETURN OF FUNDS

    In the event of a refund to a customer who previously paid by credit/debit card, whether partially or in full, and regardless of the reason for the return, the refund will be processed exclusively to the same VISA, Maestro, or MasterCard card that was used for the original payment.

    This means that our bank will, upon our request, transfer the refunded amount back to the cardholder’s account.

  8. CURRENCY CONVERSION STATEMENT
    “Please note that all payments will be effected in Euro (EUR). If the payment is done using foreign issuers payment cards, total amount of transaction will be converted into bank settlement currency, according to the current exchange rate of Visa/Mastercard.”

  9. DELIVERY
    Delivery is carried out exclusively within the territory of Montenegro. Delivery is performed by Montenegro Post. Delivery costs are borne by the Seller, and delivery is free of charge for customers. The shipment dispatch period is 1 to 3 business days, depending on operational capabilities and conditions. The delivery time depends on the conditions and timelines of Montenegro Post, over which the Seller has no control. The Seller shall not be liable for delays caused by force majeure, weather conditions, or operational issues of the delivery service.

  10. RIGHT OF WITHDRAWAL (CANCELLATION OF PURCHASE)

    The consumer has the right to unilaterally withdraw from a distance contract within 14 days from the date of receipt of the order, in accordance with Article 74 of the Consumer Protection Law of Montenegro (“Official Gazette of Montenegro”, No. 2/2014, 6/2014 – corr., 43/2015, 70/2017 and 67/2019). In order to exercise the right of withdrawal, the consumer must, prior to returning the product, submit a duly completed and signed Statement of Withdrawal from a Distance Contract to the email address info@nautical.fashion.     The original signed Statement must be delivered together with the product.

    The product may be returned in person at the retail store:

    or sent to the same address.

    BCM GROUP d.o.o. accepts returns exclusively for goods that are completely new, unused, in their original condition and packaging, with all labels and declarations, accompanied by the fiscal receipt or proof of purchase. Otherwise, the Seller is not obliged to issue a refund. The consumer bears the cost of returning the goods. After receipt and inspection of the returned goods, the refund will be made to the card used for payment, within the legally prescribed period.

  11. COMPLAINTS

    Complaints regarding material defects are resolved in accordance with the Consumer Protection Law of Montenegro. The consumer may submit a complaint by completing the Complaint Form available at the following link:
    https://nautical.fashion/dokumenta/Reklamacioni-list.pdf. The completed Complaint Form, together with proof of purchase (receipt or order confirmation) and the complained item, must be delivered to the address of the retail store:

    A decision on the complaint will be delivered to the consumer within 8 days from the date of submission, in accordance with applicable regulations.

  12. LIMITATION OF LIABILITY
    The Seller does not guarantee that the Website will operate without interruption or errors. The Seller shall not be liable for temporary unavailability of the Website, technical errors, inaccuracies caused by technical faults, or any damage resulting from the use of the Website. Use of the Website is at the user’s own risk. The Seller shall not be liable for damage resulting from misuse of data by third parties or from force majeure.
  13. INTELLECTUAL PROPERTY
    All content on the Website, including texts, photographs, graphics, design, structure, and other elements, constitutes the intellectual property of BCM GROUP d.o.o. or third parties with whom there is a business partnership. Copying, distribution, or use of content without prior written consent is prohibited.
  14. DATA PROTECTION
    Processing of personal data is carried out in accordance with the applicable laws of Montenegro and the Privacy Policy published on the Website.
  15. AMENDMENTS TO THE TERMS
    The Seller reserves the right to amend these Terms of Use at any time. Amendments shall enter into force on the date of publication on the Website.
  16. GOVERNING LAW AND JURISDICTION
    These Terms are governed by the laws of Montenegro. Any disputes shall be subject to the jurisdiction of the competent court in Montenegro.
